Location: North York, ON – Hybrid (Minimum 2 days per week on-site)

Contract Duration: 12 months with a possibility of extension with an option to extend by up to 2 years

Working Hours: M-F 35 hours per week

Pay Rate: $60-85/hour as T4 or INC (Open for discussion)

Job Title: Senior Contract Administrator

Summary of Scope of Work and Deliverables The Senior Contract Administrator will provide professional contract administrative services including responding to requests and assigned tasks, providing project support, reviewing information.

· With a focus on post-award activities in the Construction Service and Design/Engineering/Professional Service, the role coordinates post-award contract activities;

· Reviews, interprets and analyses contract requirements and contract documents, to ensure that the overall contracting strategy and individual clauses/terms are applied appropriately and consistently to reduce the risk and protect the interests;

· Reviews contractor and consultants’ submissions such as work plans, tasks/work assignments, contract changes, amendments, invoices, commercial/contractual notices, claim notices and statements, and other contractual correspondence to ensure compliance with contracts terms and conditions and the scope of the work;

· Lead and support commercial negotiations related to contract rates, work plan submissions, assignments, contract amendments, changes, claims, unit-price settlements, and other contractual matters, providing recommendations and securing commercially sound agreements that ensure fair market value and protect interests;

· Evaluates, negotiates commercial aspects of work plan submissions and processes work plan/assignment releases;

· Identifies and advises on the resolution of a range of critical contract works with the project delivery teams and vendors to resolve contractual inconsistencies, irregularities and other related issues i.e. contractor performance;

· Enforces contractual obligations and conditions by engaging internal legal representation and providing assistance in negotiations and resolution of matters, or enforcement of penalty clauses, Liquidated Damages, etc. Escalates complex, high profile issues/matters to the Commercial Manager and/or Director;

· Maintain accurate and complete contract administration records throughout the contract lifecycle, including work plan releases, contract amendments, changes, change directives, payment certificates, notices, correspondence, close-out documentation, and other contractual records within the Contract Management System and related corporate systems;

· Monitors assigned contracts and the respective progress, prepares and provides status reports to management and project teams, as required;

· Administer the full lifecycle of contract changes, amendments, claims, and change directives by evaluating entitlement, scope, pricing, schedules, labour,



material and equipment costs; preparing independent estimates and analyses; implementing claims avoidance and mitigation strategies; negotiating settlements; and processing associated approvals and contractual documentation;

· Oversees and administers payment process in accordance with approved contract price breakdowns, verifies vendors’ invoices for compliance with contract payment terms, release of statutory holdbacks (Construction Lien Act), and final payments, assesses back and set- off charges and other payment related matters i.e. offsite inventory payments and liquidated damages;

· Prepares price estimates for material, labour, equipment costs, analyses production, construction schedules for evaluating contractor’s contract changes, claims pricing submission and proposed changes/amendments/claims;

· Monitor contract performance, progress, expenditures, allowances, contingencies, forecasts, and commercial risks; prepare analyses and status reports; and provide recommendations to management and project teams to support effective financial and contractual decision-making;

· Chairs negotiations to establish acceptable settlement of price and terms for contract changes and claims with contractors and co-ordinates support from other key stakeholders;

· Negotiates final settlement of quantities for unit price contracts;

· Processes Requests for Quotes, Contract Amendments/Changes and Change Directives and reviews and provides input in development of Purchase Authorization Amendment Board Reports;

· Attends progress and engineering review meetings as required;

· Prepares Performance Review Reports and participates in meetings regarding “unsatisfactory” performance review reports;

· Processes documentation for contract close-out;

· Contributes expertise and advice to the design, planning, development of the existing contract management systems, standards and operational procedures, including recommendations to improve/adjust contract management processes/procedures.

· Other activities assigned within the scope of the Commercial Management Department.

· Ensure all performance KPI’ s Target is met.

Qualifications and Experience

· Great attention to detail, and capable to perform contract administration with great quality without close supervision;

· Strong knowledge, and experience in contract administration practices in complex construction and infrastructure environments;





· Ability to read and comprehend technical specifications and drawings and possess a valuable understanding of technical issues related to engineering design and construction as well as a very good understanding of legal and commercial issues and practices related to tender and contract law;

· Strong knowledge of contracting principles, processes, methods, practices as well as accounting and scheduling principles;

· Proven experience in managing projects and contracts in a multi-functional environment;

· Knowledge of quality assurance and quality control principles, practices and methods to lead the implementation of controls for contract management processes;

· Strong knowledge of claims management techniques and practices in a large scale, multi-faceted environment;

· Solid negotiation and oral/written/presentation skills to manage contract administration and commercial management issues;

· Sound interpersonal and oral/written/presentation skills to present complex and/or new ideas with clarity and simplicity, liaise with all levels within the organization and in the field, and work effectively with specialists across multiple sectors;

· Demonstrated experience in assessing situations to determine the importance, urgency and risks, and make clear decisions that are timely;

· Good negotiation skills and the ability to develop strategies and chair complex negotiations;

· Knowledge of risk management systems and processes to identify and mitigate risk; Recognized organizational and research skills to conduct research into current trends, leading practices, tools and technologies;

· Demonstrated project management abilities and the ability to achieve results;

· Strong knowledge of contract administration best practices including quality assurance techniques;

· Proficiency in MS Office (Excel, Word, Visio) with an understanding of database management systems;

· Excellent planning and time management skills; ability to multi-task and work in a fast- paced, high change environment;

· Good understanding of relevant legislation;

· Understanding of construction planning, scheduling and management;

· Must have or rapidly acquire a comprehensive knowledge of the Ontario Human Rights Code and Related Orders including disability accommodation and accessibility requirements pertaining to passengers and employees.

Formal education/training through which skills normally acquired:

Completion of a University Degree or College Diploma, preferably in Civil, Architecture, Mechanical, Electrical Engineering, and/or Quantity Surveying.

Assets:

Has certification from Certified Construction Contract Administrator (CCCA), a member of Royal Institute of Chartered Surveyors (RICS), Professional Quantity Surveyors (PQS) or similar designation, or a combination of education, experience and training deemed to be equivalent; combined with directly related work experience in the commercial, contracts management and administration of complex requirements.
