JOB SUMMARY:

There comes a point in every litigator’s career when the question changes.

At first, the question is:

- Can I do this work?

Then it becomes:

- How far can I take this?

That is the question behind this opportunity.

Bianchi Presta LLP is an award winning, mid sized, full service law firm in Vaughan, and we are looking for an Associate Lawyer with a minimum of two (2) years of meaningful litigation experience who wants to accelerate the next stage of their development.

We are looking for a litigator. Someone who wants to learn by doing.

Someone who wants real files, real clients, real advocacy and real responsibility, with experienced senior litigators directly involved in their development.

The successful candidate will work under the direct supervision and mentorship of our Managing Partner and Litigation Practice Group Chair across a broad litigation practice involving matters of different sizes, complexity and forums.

One week may involve a significant commercial dispute.

The next may involve a construction matter, tribunal proceeding, Small Claims Court hearing, examination for discovery, mediation, motion or preparation for trial.

That range is intentional.

THE OPPORTUNITY:

We do not believe developing lawyers should spend years completing isolated assignments without understanding the strategy behind the file.

We also do not believe in handing a junior lawyer a matter and telling them to figure it out alone.

The model is deliberate: involvement, supervision, feedback and increasing responsibility.

We want you to understand:

- What the evidence actually proves.
- Where the strengths and weaknesses of the case lie.
- What the client is trying to accomplish.
- Why a particular procedural or strategic decision is being made.
- When to push.
- When to negotiate.
- When settlement creates more value than continued litigation.
- How each step advances the larger strategy.

As your judgment, preparation and reliability develop, so will the responsibility entrusted to you.

The objective is simple: to help you become a more capable, confident and strategic litigator who has an interest in setting down roots in the City of Vaughan.

WHAT YOU WILL DO:

The successful candidate will work with senior litigation counsel on matters including:

- Commercial and civil litigation matters of varying size and complexity.
- Construction disputes, including construction lien proceedings, adjudications, contractual disputes, deficiency claims, delay claims, breach of trust claims, bond claims and related proceedings.
- Small Claims Court proceedings.
- Tribunal and administrative proceedings.
- Debt recovery and collection matters.
- Breach of contract, warranty, negligence and other business disputes.

Your responsibilities will include:

- Reviewing evidence and participating in the development of litigation strategy.
- Drafting pleadings, affidavits, motion materials, facta, legal opinions, settlement documentation and other litigation materials.
- Conducting legal research and analysis.
- Assisting with and, where appropriate, conducting examinations for discovery and other examinations.
- Managing documentary productions,



undertakings and related evidentiary issues.
- Retaining, instructing and working with expert witnesses.
- Preparing for and attending motions and other court appearances.
- Preparing for and attending mediations, adjudications, arbitrations, pretrials, tribunal hearings and trials.
- Appearing before the Small Claims Court and tribunals where appropriate to your experience and demonstrated capability.
- Participating in negotiations and settlement discussions.
- Communicating with clients and progressively developing responsibility for client reporting and advice.
- Working closely with Partners, Associates, Law Clerks, Legal Assistants and other members of the litigation team to advance files efficiently and strategically.
- Travelling within Ontario where reasonably required for court attendances, examinations, mediations, hearings, client meetings and other litigation related matters.

SKILLS AND QUALIFICATIONS:

The successful candidate will have:

- A JD or LLB from a recognized law school.
- Membership in good standing as a Lawyer with the Law Society of Ontario.
- A minimum of two (2) years of meaningful litigation experience.
- Experience in civil, commercial, construction or comparable litigation matters.
- A strong working knowledge of the Rules of Civil Procedure.
- Experience drafting pleadings, affidavits, motion materials and other litigation documents.
- Experience conducting or materially participating in examinations for discovery.
- Experience attending motions, mediations, hearings or comparable contested proceedings.
- Strong legal research and analytical skills.
- Strong written and oral advocacy skills.
- Sound professional judgment and discretion.
- The ability to manage multiple active matters, competing priorities and strict deadlines.
- Solid organizational and file management skills.
- The ability to communicate professionally and confidently with clients, opposing counsel, experts and adjudicators.
- The ability to work independently on assigned responsibilities while recognizing when guidance, collaboration or escalation is required.
- A genuine commitment to teamwork.

Experience with the Construction Act,



construction liens and related jurisprudence is a significant asset.

COMPENSATION AND BENEFITS:

Annual compensation ranges from CA$90,000 to CA$140,000, commensurate with relevant experience, litigation capability and demonstrated professional judgment.

This is a full time, in person professional position based at our Vaughan office, subject to court appearances, examinations, mediations, hearings, client meetings and other professional obligations.
