Victoria, BC V9B 6X2 CA The candidate must determine whether issues fall within the jurisdiction of the CRT and make initial assessments of issues that may fall outside the CRT’s jurisdiction, subject to reconsideration by a tribunal member.
The candidate must determine whether additional parties should be added to the dispute and, where appropriate, make recommendations to the parties or refer the issue to a tribunal member for a determination.
The candidate must determine whether a final judgment has been issued when an issue or similar issue has previously commenced through a separate proceeding or is currently before the CRT or another judicial or quasi-judicial body and, if not, work with the parties to determine whether the CRT is the appropriate forum for dispute resolution.
The candidate will be responsible for determining the facilitated dispute resolution strategies to use during the case management phase for each dispute in accordance with the Civil Resolution Tribunal Act, CRT rules, CRT policies, and the principles of administrative law.
The candidate will be responsible for providing directions and deadlines to parties involved in CRT disputes, including, where necessary, written reasons and directions to clarify issues and positions, disclose evidence, produce records or other things in their possession, prepare an agreed statement of facts, and arrange for expert evidence.
The candidate must prepare consensual dispute resolution agreements for the parties and draft consent resolution orders to implement those agreements, recognizing that the financial and legal impacts on the parties may be significant.
The candidate must determine the appropriate resources to allocate on a systemic and individual case basis.
The candidate must conduct online, telephone, and in-person facilitation activities, control those proceedings,
and record and provide written confirmation to the parties of any directions given or resolutions reached.
The candidate will be responsible for providing the parties, where appropriate, with a non-binding neutral evaluation of the claims in the dispute, an opinion on how the court or CRT would likely resolve the dispute if it proceeded to a hearing, or, with the parties’ consent, a recommendation to a CRT member on a final decision resolving the dispute.
The candidate will be responsible for identifying cases where the CRT may need to refuse to resolve the case or where a party has failed to comply with a Case Manager’s direction or a requirement of the CRT Act or Rules, and then preparing a report and recommending an appropriate course of action to a CRT member.
The candidate must decide whether to terminate facilitation of disputes based on statutory criteria, recommend the method of hearing for unresolved disputes, and may order a party to pay another party’s costs for the facilitation process.
The candidate must ensure due process in accordance with legislation, the principles of administrative law, and applicable professional and ethical standards.
The candidate must participate in continuing education activities to maintain current knowledge of relevant issues, law, and guidelines, with a special focus on administrative justice matters and the area of specialization.
The candidate must participate in program meetings to harmonize the standards, criteria, and interpretations applied in various cases and make recommendations to improve program effectiveness and the fairness of decisions.
The candidate must provide feedback on ongoing policy and technological development and actively participate in technology user acceptance testing.
The candidate must provide information and advice to the public and other agencies regarding the CRT’s policies and procedures.
Job Requirements The candidate must have a degree or diploma related to law and/or dispute resolution, public or business administration.
The candidate will be considered if they have an equivalent combination of education, training and experience.
The candidate must have a minimum of 1 year of recent experience acting as a mediator in formal mediations, including drafting settlement agreements or related documents.
The candidate may qualify through equivalent experience facilitating disputes or settlement discussions or acting as an advocate in mediations or settlement discussions.
The candidate must have 1 year of experience interpreting and applying legislation, regulations, and policies.
The candidate must have 1 year of experience conveying information in plain language, both verbally and in writing.
The candidate must have 1 year of experience providing competent, timely, respectful, quality service to the public in a high-volume, fast-paced environment.
The candidate must have 1 year of experience managing a high-volume case load and individual case files in a customer service environment.
The candidate must have 1 year of experience working respectfully with individuals from diverse backgrounds, listening and understanding their concerns, and effectively managing angry, frightened, or distraught behaviour.
Preference will be given to candidates with mediation or negotiation training.
Preference will be given to candidates with experience interpreting and applying the Strata Property Act, laws related to small claims civil disputes (debt, goods and services, personal injury, personal property, and specific performance of agreements), and/or ICBC disputes.
Preference will be given to candidates with experience supporting victims of sexualized violence.
Preference will be given to applicants who self-identify as having Indigenous heritage (First Nations, Métis or Inuit) and possess the required combination of education and experience.
The candidate must be located in British Columbia at the time of employment.
