The position of Solicitor serves as a strategic legal advisor for Health PEI. The incumbent will provide legal services to the Executive Leadership Team and Senior Management. The Solicitor, based on operational need, provides legal advice and analysis to various services areas on contracts, complaint resolution, company initiatives, professional regulation, confidentiality and access to information, patient safety and risk management, and litigation or potential litigation involving Health PEI.

The solicitor provides legal advice and conducts research on a range of legal questions requiring the interpretation and application of varied and complex legislation. Work may involve acting as Health PEI’s legal representative or liaison with external counsel or third-party agencies and providing legal counsel in matters of substantial importance to the operations of Health PEI. Provide a broad range of practical and strategic legal advice based on a review of applicable legislation, legal principles, and contractual obligations, and in consideration of operational requirements and Health PEI’s service delivery and mandate; Participate and provide legal advice on company projects and initiatives in the planning stages; Based on operational need and as assigned, act as legal advisor and provide legal advice in various areas, such as complaint resolution, medical by-laws, requests, investigations and cases involving professional regulatory bodies, legislative interpretation and development, substitute decision making and guardianship, patient safety and risk management, policy development, confidentiality and freedom of information,



and other matters of substantial importance to Health PEI; Conduct research and compile documentation and information in preparation for litigation; review, revise, and approve pleadings and other litigation related documents.

Juris

Doctorate/ Bachelor of Laws Member of the Law Society of Prince Edward Island* Extensive experience practicing law with experience in health care industry/equivalent: Proven experience advising Senior Leadership and Board Committees on corporate governance, public sector accountability frameworks, administrative bylaws, and institutional risk management Experience in the practice of health law Comprehensive knowledge of, and experience interpreting and applying, provincial healthcare legislation and regulatory frameworks, such as, Health Services Act, Hospitals Act, Hospital Management Regulations, Canada Health Act, Mental Health Act, Regulated Health Professions Act and Regulations, Public Health Act, Adult Guardianship and Trusteeship Act, Capacity Assessment Regulations, legislation governing power of attorney, Consent to Treatment and Health Care Directives Act, Adult Protection Act, Child, Youth, and Family Services Act, Ombudsperson Act, Health Services Payment Act and Regulations, Criminal Code (Criminal Code Review Board), medical staff by-laws, collective agreements,



the legal and regulatory framework of the College of Physicians and Surgeons of PEI and the College of Nursing and Midwifery of PEI (or equivalent) Demonstrated ability to provide immediate, practical legal counsel to clinical teams on consent to treatment and substitute decision-making Proven experience in drafting, reviewing, and negotiating contracts & vendor service level agreements. Excellent interpersonal skills in negotiation, conflict resolution, litigation and dispute resolution skills Strong team player who enjoys working with multidisciplinary business groups in a dynamic environment to resolve a broad range of legal issues Self-motivated, creative and results oriented Experience in the unionized environment would be an asset Experience representing or advising clients in front of administrative tribunals, information and privacy commissioners, or provincial qualified regulatory colleges would be an asset Knowledge and experience related legislation governing the health care sector in Prince Edward Island would be an asset * Graduation from a recognized Canadian law school and membership in the Law Society of Prince Edward Island or other provincial Law Society is required.
