You will lead legal diligence and underwriting of prospective litigation finance investments across Canada. This is a role for an accomplished Canadian litigator who wants to move to the principal side, evaluating cases as investments rather than litigating them.
What You’ll Do
- Conduct in-depth merits assessments of Canadian commercial litigation and arbitration matters: liability, damages, limitation periods, enforceability, appeal risk, and duration
- Assess the distinct economics of Canadian litigation, including adverse costs exposure, security for costs, and the loser-pays regime, and structure protections accordingly
- Underwrite class proceedings, including certification/authorization risk in Ontario, British Columbia, and Québec
- Structure single-case, portfolio,
and monetization investments; draft investment memoranda and present to the Investment Committee
- Negotiate term sheets and litigation funding agreements compliant with Canadian jurisprudence
- Monitor funded matters through trial, appeal, and resolution
What You Bring
- LLB/JD and 7+ years of complex commercial litigation or arbitration experience at a leading Canadian firm
- Called to the bar of Ontario or another Canadian province or territory, in good standing
- Deep familiarity with Canadian civil procedure, costs regimes, and damages assessment
- Commercial judgment: you can distinguish a solid case from a fundable investment
- Bilingualism (English/French) a strong asset, particularly for Québec matters
