The Role You will lead legal diligence and underwriting of prospective litigation finance investments across Canada. This is a role for an accomplished Canadian litigator who wants to move to the principal side, evaluating cases as investments rather than litigating them. What You’ll Do Conduct in-depth merits assessments of Canadian commercial litigation and arbitration matters: liability, damages, limitation periods, enforceability, appeal risk, and duration
Assess the distinct economics of Canadian litigation, including adverse costs exposure, security for costs, and the loser-pays regime, and structure protections accordingly
Underwrite class proceedings, including certification/authorization risk in Ontario, British Columbia, and Québec
Structure single-case, portfolio,
and monetization investments; draft investment memoranda and present to the Investment Committee
Negotiate term sheets and litigation funding agreements compliant with Canadian jurisprudence
Monitor funded matters through trial, appeal, and resolution What You Bring LLB/JD and 7+ years of complex commercial litigation or arbitration experience at a leading Canadian firm
Called to the bar of Ontario or another Canadian province or territory, in positive standing
Deep familiarity with Canadian civil procedure, costs regimes, and damages assessment
Commercial judgment: you can distinguish a strong case from a fundable investment
Bilingualism (English/French) a strong asset, particularly for Québec matters Apply
