Real Estate Litigation CounselEmployer:Marberg StaffingBase pay rangeCA$110,000.00/yr – CA$150,000.00/yrJob Type:Full‑Time PermanentCompensation:From $110,000 to $150,000 per annum, plus year‑end bonus and benefitsRegular Work Hours:9 am – 6 pm, Monday – Friday (40 hours per week); occasional overtime maybe requiredWork Location:100% onsite at client’s East GTA office, free parking providedTravel Requirements:Occasional local travel to other GTA sitesPosition Reports To:Head Legal Counsel and CFOResponsibilities SummaryIn‑house Litigation Counsel responsible for expanding the in‑house legal team and independently managing a portfolio of litigation and pre‑litigation matters, including condominium purchaser defaults, tenant disputes, commercial lease and contract conflicts. Supports project teams, external investors, property management, sales, marketing, accounting and executive teams across new residential and commercial developments.Serve as internal advisor on real‑estate‑related issues, guiding projects to make legally sound decisions throughout the development life‑cycle.Manage and oversee litigation and pre‑litigation matters involving project disputes, contract enforcement, occupancies, and purchaser claims.Respond to demand letters, draft pleadings, prepare affidavits, and handle negotiations and mediations.Support preparation and review of disclosure statements, purchase agreements, assignment agreements and related documentation; provide guidance on Tarion warranty matters.Identify and mitigate legal risks across development projects and corporate activities; assist with resolution of disputes and claims during turnover, post‑registration or post‑construction phases.Represent the company at mediations, arbitrations, tribunal proceedings and court proceedings as required.Additional advisory,



dispute resolution and litigation matters as required.QualificationsEducation:JD/LLB from a recognized law school.Professional Credentials:Member in good standing with the Law Society of Ontario.Preferred Work Experience:Approximately 3+ years of post‑call experience in commercial and residential real estate litigation.Preferred Sector Experience:Law firm or in‑house legal experience in dispute resolution (litigation, mediation, arbitration) related to real estate law, condominium law, contracts law or construction law.Technical and Language SkillsProficient with Microsoft Office, Adobe Acrobat, Google Drive, and Ontario Courts Public Portal (OCPP)/Justice Services Online (JSO) Portal.Expert level English communication skills, both written and verbal.Task‑Based Qualifications and Additional AttributesAbility to independently manage files and meet deadlines in accordance with the Rules of Civil Procedure.Sound knowledge of the Ontario Condominium Act, Ontario Current Home Warranties Plan Act, Tarion and HCRA requirements, and construction lien legislation.Experience with residential and commercial real‑estate transactions and development processes.Demonstrated record of professional conduct and character. Responsible, reliable and deadline‑oriented.Proven ability to respond to sensitive and confidential matters with tact, discretion and excellent judgement in the interpretation and application of instructions and organization policy.Demonstrated ability to apply project management principles,
